Wrongful Death
There are two different types of wrongful death actions.  There is a separate statutory cause of action for specific heirs.  And, the victim’s estate may pursue damages through a survival action.  The specified heirs are entitled to recover damages on their own behalf for losses that they have sustained due to the victim's death. 

These damages may include:
 
Medical expenses paid by the claimant on behalf of the decedent 
Loss of society, enjoyment, and consortium of the decedent
Loss of potential earnings of the decedent
Any additional economic loss sustained due to the death of the victim

Under certain circumstances, it may also be possible for the heirs to pursue a separate cause of action for emotional distress. 

If the victim’s estate pursues damages through a survival action, these damages may include medical and other expenses incurred by the victim prior to death.
