There are two different types of wrongful death actions. There is a separate statutory cause of action for specific heirs. And, the victim’s estate may pursue damages through a survival action. The specified heirs are entitled to recover damages on their own behalf for losses that they have sustained due to the victim's death. These damages may include: • Medical expenses paid by the claimant on behalf of the decedent • Loss of society, enjoyment, and consortium of the decedent • Loss of potential earnings of the decedent • Any additional economic loss sustained due to the death of the victim Under certain circumstances, it may also be possible for the heirs to pursue a separate cause of action for emotional distress.
